Terms of Service

These Terms of Service ("Terms") are a plain-English agreement between you and NomBot.ai, a product built by a solo developer doing business as Mindless AI LLC ("NomBot," "we," or "us"). Please read them before using the app or website.

1. Acceptance of Terms

By downloading, installing, creating an account, or otherwise using NomBot, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the service.

2. The Service

NomBot is a food-recommendation app for iOS and Android. It helps you discover nearby restaurants, save preferences, and "spin" for a meal when you can't decide what to eat. Available features, pricing, and supported regions may change as the app evolves.

3. Accounts

• You may create one NomBot account per person. Accounts are personal — do not share them.
• Keep your sign-in credentials (Apple ID, Google account) secure. You are responsible for all activity that occurs under your account.
• You must be at least 13 years old to use NomBot. If you are a minor in your jurisdiction, your parent or guardian must agree to these Terms on your behalf.
• Let us know promptly if you suspect your account has been accessed by someone else.

4. Subscriptions & Founders

NomBot offers a free tier and paid upgrades. Paid options are purchased through the Apple App Store or Google Play and are subject to their billing terms.

• NomBot Pro is an auto-renewable subscription. Your subscription automatically renews at the end of each billing period at the then-current price unless you cancel at least 24 hours before the period ends.
• You can manage or cancel your subscription at any time through your Apple ID or Google Play account settings. Cancellation takes effect at the end of the current billing period.
• Founders is a one-time purchase that grants lifetime access to Pro-tier features as they exist today. "Lifetime" means for the operational life of the NomBot service.
• Refunds are handled directly by Apple or Google under their respective refund policies. We cannot issue refunds for charges processed by those stores.
• Prices, features, and availability of paid tiers may change; we will give you reasonable notice before any change to an active subscription.

5. Acceptable Use

When you use NomBot, you agree not to:

• Scrape, crawl, or otherwise bulk-extract data from the app or our APIs.
• Reverse-engineer, decompile, or attempt to extract the source code of the app, except where applicable law expressly permits it.
• Harvest restaurant data or user information for commercial or competitive purposes.
• Abuse, harass, or attempt to harm other users, our partners, or our staff.
• Use NomBot to violate applicable laws, regulations, or the terms of our service providers (Apple, Google, etc.).
• Interfere with, overload, or disrupt the service or the networks it runs on.

6. Content

Restaurant listings, menus, hours, photos, and other third-party content shown in NomBot are sourced from providers such as Google Places. We display that content as-is and do not guarantee its accuracy, completeness, or availability. Always confirm important details (hours, prices, menus, dietary information) directly with the restaurant before relying on them.

7. Disclaimers

NomBot is provided "as is" and "as available," without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee that recommendations will be suitable for any specific dietary need, allergy, medical condition, or lifestyle. You are responsible for verifying that a recommended restaurant or dish is safe and appropriate for you.

8. Limitation of Liability

To the maximum extent permitted by law, NomBot and Mindless AI LLC will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or goodwill arising out of or related to your use of the service.

Our total aggregate liability to you for any and all claims arising out of or related to the service is limited to the greater of (a) the total amount you paid us in the twelve (12) months before the event giving rise to the claim, or (b) USD $100.

9. Termination

You may stop using NomBot at any time and may delete your account in-app via Profile > Account > Delete Account. We may suspend or terminate your access if we reasonably believe you have violated these Terms, abused the service, or created risk or legal exposure for NomBot or other users. Sections that by their nature should survive termination (including Disclaimers, Limitation of Liability, and Governing Law) will continue to apply after your account ends.

10. Governing Law

These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws principles. You and NomBot agree that any dispute arising out of these Terms or the service will be resolved in the state or federal courts located in Texas, and you consent to personal jurisdiction there. Nothing in this section limits any non-waivable rights you have under the laws of your home jurisdiction.

11. Changes to These Terms

We may update these Terms from time to time. When we do, we will revise the "Last updated" date at the top. For material changes, we will notify you by email or with an in-app notice before the changes take effect. Your continued use of NomBot after the effective date constitutes acceptance of the updated Terms.
